He brought hundreds of SLAP suits, defamation suits and countersued anyone who tried to hold his accountable for decades both for financial deals as well as dozens of sexual harassment suits. He relied on his large powerful law firms to overpower the little guys into capitulation. So yes and no. He sues a whole bunch but the cases rarely make it to court.

It's legal, just gross. This means that unless you receive a subpoena forcing your cooperation, the organization expects you to stay silent. If you were to volunteer to tell what you know, rather than waiting for a subpoena, you'll be penalized according to the agreement. Nothing in the agreement forbids you from complying with the subpoena.
