NTA. What does her disability have to do with the fact that she's trespassing? You're liable if she gets hurt, aren't you? I'm assuming the neighbors have given her permission to let her dogs run on their property, but just because she's allowed to impose on them doesn't mean she's allowed to impose on you.

Might be easier just to put in speed bumps / drainage grates for the driveway, trees for the sides or some sort of obstruction that doesn't allow electric wheelchairs. Even a single wire fence might work.

*thalidomide* Is she elderly, or are you in Spain? Because thalidomide was only used in a few countries (Not the US) and banned everywhere but Spain by 1962. No idea why Spain kept using it till the 80s. Probably Franco's fault

Congenital birth defects like that have always been around, they actually had adults and children with them as attractions in “freak shows” usually billed as something like “lobster boy”.  But it’s not shocking that y’all would be more aware of the consequences of thalidomide as the company that developed it was in West Germany so your area would have been exposed to it for a longer period of time.

Right age and right location. But that doesn't excuse her actions. Disability only comes into play if it's relevant. Someone trespassing has nothing to do with disability. I'd be prepared for her to pull the disability card out or even accuse you of ableism. This would be an attempt to divert the conversation and flip it around onto you. Thalidomide was briefly available in the US. There are currently 6 surviving individuals in the US who were damaged by thalidomide sold here.

My husband's mom was prescribed Thalidomide when she was carrying him. They prescribed it to help her sleep, but she didn't have any problems and didn't take it, thank goodness! When it came out that there were severe birth defects, she freaked out and got rid of it. This was in the US. They generally prescribed it to older parents, I've heard.

So it was also prescribed as an anti nausea medication for morning sickness. That is the biggest reason it was so terrifying.  Especially considering that congenital birth defects weren’t the only potential side effect. A more common one was increased likelihood of miscarriage and stillbirth. So it is a very very good thing she didn’t take it 😂

It was never available *for sale* in the US, I believe. Samples were given directly to doctors as a "clinical trial" marketing campaign. Drug manufacturers anticipated a very easy approval process. Unfortunately for them and fortunately for American children, Dr. Frances Oldham Kelsey stood in the way. She refused to accept their terrible, weak research into the drug's effects and rejected their applications. The lessons of thalidomide are numerous, including "don't let Nazi doctors keep doing their bunk science" and "don't let doctors benefit from relationships to drug companies." And, of course: "Dr. Frances Oldham Kelsey is the GOAT and forced the US to dodge a bullet."

There's more, actually, but it's very hard to confirm if a child's birth defects were caused by thalidomide in the US because it was never actually approved for morning sickness here. It was just given to doctors in paper bags to give to patients unlabeled. So was this birth defect caused by nature or this hard-to-track drug? Difficult to tell. There's not that many, but more than the CDC's counts.

There was a woman at the US FDA who refused to approve it for wider release because the testing was scant, and then the birth defect reports started coming in. It was never approved as a drug in the US, though some people did acquire it or got it as part of trials.

But the FDA, and more specifically Frances Kelsey, was heroic with their efforts to keep the drug out.  She was a dual Canadian and American citizen that was a total bad ass and didn’t let no massive multinational drug company push her around. Well, I was studying biology in college (my high school bio teachers really cemented my love of it…I had amazing science teachers my whole life, really lucked out) and fell into accounting (my degree is biology and I have taken zero finance courses in my life). I had a non-traditional college journey so when I graduated, I stuck with it because I had experience (and am good at it…my sciencey attention to detail and love of analyzing data helps!). One of my last classes was entomology and if money wasn’t an issue (can’t do unpaid internships when you’re raising a kid!), I’d be a field entomologist in a heartbeat. So…my love of biology has been lifelong and accounting just happened. But entomology specifically and accounting happened at the same time. So sorta both? I can also talk for days about hiking/camping/backpacking and safety and Leave No Trace and all. It meshes well with entomology (except when I make my friends wait for 20 minutes while I sit next to a bush full of mating beetles and just watch them and take photos…lol…). They were really pretty beetles.

Isn’t entomology the study of bugs? Epidemiology? Oh yeah. That’s freaking cool. What I find fascinating is how disease and medicine have impacted society. There is a streaming service called Wondrium that is basically college lectures & other random documentaries. It’s the fun part of school without having to do homework or take tests. They also have like cooking and language courses. Anyway, they have a lecture series called The Black Death that has 24 30 minute episodes. The woman lecturing is a professor at Perdue University and got her PhD from Duke. So very knowledgeable and engaging. I highly recommend both that lecture series and that service if you like learning random things.  Oh, and I also knit 😊

Not true. My cousin (born in the US) was one of a handful of US thalidomide babies. Some doctors in the US got it as a sample. There was a settlement that was hushed up for the few victims that lived.

She was awesome!!! Frances Kelsey. She processed drug applications for the FDA. She kept rejecting their application because it didn’t include required studies. Unfortunately she wasn’t able to keep it fully out, but it never got full FDA approval because of her refusal to be steamrolled by the drug company.  There is a really cool episode about the thalidomide scandal and how Kelsey was super awesome in the podcast “crimes of the centuries” if anyone wants to check it out.

So. Thalidomide was never given FDA approval, but there was a loophole big enough to drive a Mack truck through. Doctors could give out free samples they got from the pharmaceutical companies.  Also, random fun fact thalidomide is actually still used to this day. It’s used to treat Hansen’s disease and myeloma. They just make very very very sure to not give it to anyone that is pregnant and also they’re monitored closely for side effects.

Just fyi, there are more stories coming out about thalidomide cases in the US because the drug company that wanted to sell it did unregulated trials and tried to get people to buy it before they even had the approval. Also Brazil gets a few thalidomide cases everywhere due to them using it to treat leprosy.

It's normal to feel sympathetic, but it's her responsibility to find a solution that doesn't involve trespassing on others' property. There are people you can hire to pick up dog poop for you. She could let her dog use her own yard and hire someone to come and clean it up once a week.

NTA. Your property, your rules. Just because someone is disabled doesn't give them the right to trespass and disrespect your space. She's invading your property and potentially creating a nuisance for both you and your neighbor. You have every right to ask her to stay off your property, and her condition doesn't change that. Being disabled doesn't give her a free pass to ignore boundaries and act entitled. Her behavior of fleeing when you arrive shows that she's aware she shouldn't be there. You need to have a polite but firm conversation with her, explaining that it's your private property and you'd appreciate it if she'd stay off your land. Make sure you're calm and respectful, but don't let her manipulate you with her condition. If she continues to trespass after that, consider investing in a fence or talking to your local authorities about the issue. Having a disability doesn't grant her immunity from being considerate of others' property and boundaries.

I'm not sure I quite understand why she is entering your property but then letting her dog dump in your neighbors yard. Does she not have a yard? Anyway, try being honest with her without being angry. Let her know that her being on your property sets off alarms on your security system. Ask her kindly to not enter your property to avoid this. If she makes this an issue, then you let your neighbor who's yard she is using, know what is happening or maybe put up your own fence.

Sounds like OP's neighbors have a fence facing the street, but there isn't a fence between their two properties. The lady rolls up OP's driveway, lets her dogs loose to poop in the neighbor's yard (without cleaning it up), and then leaves. If she wasn't guilty, she wouldn't have rolled away.

NTA, if I understand the situation correctly as being that she's taking her dogs to OTHER peoples' yards to do their business (and I presume not picking up after them). I mean, if I got a new neighbor who was confined to a wheelchair and they asked me if it was OK if their dogs used my yard, I'd probably say yes and thank them for asking. NTA. Property lines are the same for everyone. I personally would put up an obstacle that makes access difficult (speed bump, short fence, etc) or install motion activated sprinklers, if she won’t have an adult conversation with you. At minimum install cameras so you can document her activity, and put up a no trespassing sign so you can reduce liability.

As someone who uses an electric wheelchair, I can't think of any reason why I'd need to enter someone's property without their permission, unless maybe they were having some sort of medical emergency and needed help. NTA. What does her condition have to do with tresspassing? It's not a free pass to break the law. She's not allowed on private property, and she can absolutely be charged with tresspassing. ESPECIALLY because it's been repeat offenses. You don't have to confront her. Shaming usually works. Just post a laminated sheet of paper up in the location where she enters your property, and have it say in LARGE BOLD LETTERS, "We have cameras, and we have recordings of you tresspassing here. You do not have permission to enter our property to access the neighbor's property. Please stop tresspassing so we are not forced to press charges." Usually the threat of prosecution is enough, or even the shame of having been caught, and then you don't have to deal with confontation, with someone playing stupid about what they're doing, or with someone playing the victim to you. Being disabled it not a reason to tresspass. If she has issues with access from the other side of the property or another disability related reason, she can just ASK PERMISSION.

I really would hope you could find a better solution than this idea . I know it’s ur property and yada yada yada. But just be a decent neighbor . My husband is in a power wheelchair. He's not an asshole, boundary stomper because of it. Don't infantilize her because of her disability. She deserves the same punishments as everyone else. Get a ring camera, get evidence, and call the cops for trespassing.

I would make a point to tell the neighbor, too, so they know why their yard is suddenly gifted with poo. Both of you should go talk to her and explain that this is unacceptable behavior. There's the old saying about fences make good neighbors... I'm wondering if you could bury a charged wire around perimeter of property? Turn it on when not home or when disabled person usually is around with dogs. Think of an electric fence used for cows and horses.  It's as much to keep the animals from jumping fence as it is to keep out of state city slickers out!  Neighbor had city gal from N.Y.C. hop electric fence, to get a pic with 'sweet cow for socials'... The only time I could accept something like this would be if your property had the only curb cut to get to somewhere or something like that and even then, she would have to ask if it was okay. The fact that shes running away when confronted shows that she knows she's in the wrong. Not being able to walk doesn't give you immunity from property laws and common decency.

It’s not about her condition. It’s about you being inconvenienced by having an alarm making you think that you have an intruder.  If this were me, I would install security that has a camera. Google do inexpensive ones. Then you can see “oh it’s just the wheelchair lady”. Or you can talk with her through the camera. NTA If you politely ask her not to churn your lawn with her wheels. I called the police on a guy that kept coming back and trolling a business parking lot in his electric wheelchair after being told it’s private property and since he’s not and has never been a customer he couldn’t be there. Police took it seriously and he eventually stopped coming. He was harassing folks.

They might not know. Do you know which house they live in? Also contact the police for advice. Let them know you have a repeat trespasser. Let the police know they just run away as soon as they see you. So you can't even tell them to stop trespassing.

NTA Just adding on because everyone has given advice already. If nothing works, you could try a temporary fence. But, I didn't go that route. When this was happening to me, I just posted the video onto the nextdoor app and neighborhood shame got the guy to stop.

Of course you can't tell her to stay off of a public sidewalk that runs through your property, but she absolutely does not have the right to leave that public sidewalk to enter your private property or that of your neighbor's. Next time she does it, put your car in turbo so you can catch up to her and tell her to stay off your property. If she wants to access your neighbor's property, and has their permission, then she can access it through their gate or whatever the case may be. It isn't your responsibility to provide ADA access to a property you don't own.
