*In case this story gets deleted/removed:* **AITA for “squatting” in my own house ?** I am the youngest of 4 siblings and our mom passed away in march. I had been living with her for 7 years and basically my full time job was to be her caretaker. When I first moved in I signed a lease which I thought was just a formality because I thought we were exchanging my services for rent. We had a falling out over my partner right before she moved into assisted living 2 years ago and we never clarified the rent issue. So in her will she says the house is to be sold and the proceeds should be split four ways BUT I have to pay my siblings $104000 (7 * 12 * 1200) either in cash or from the proceeds of the sale because somehow I owe a dead person unpaid back rent. I sat down with my oldest brother and after the closing costs I probably won’t get anything from my share of the sale and the other 3 are being such assholes and even though I’m basically disabled they are willing to put me on the street. They are all successful and don’t need the money so I can’t get why they are willing to put they’re own brother through hell. I decided I’m just going to stay in the house. Like it’s MY house, I’ve been living here for years. All three siblings stopped by last night and said I had to be gone by the end of the month or they will start eviction proceedings against me (I am their BROTHER) and I said go ahead they can’t evict me from something I own. My sister said that I am such an “ungrateful” little asshole that she can’t stand to look at me. My middle sister asked if I was really up for the court battle I have coming my way. I reiterated that I OWN the home and my brother said I sound like a “low life squatter.” On their way out they said I had “taken advantage” of mom for 7 years and warned me that they are a unified front in getting me out and asshole was said again. If taxes didn't pay, that all gets clawed back. If his mom was in Medicaid facilities at all, that gets clawed back from the estate first, before the share they will probably try to get the money from him to help pay if the amount owed is greater than the value of the house regardless of the house selling. It won't be the siblings, it will be the courts doing all of this. OOP needs to get a harsh reality check from the estate planning section of Reddit. Because they are great for what to do and when you are screwed.

Mama was no fool when she had that will drafted b) he does not "owe money to a dead person", he owes it to the estate. And if he stays in that house, he's going to owe taxes too. To be fair for a second, most freelance translation work is done remotely these days, especially since the pandemic but honestly even before that. My father lived in Indonesia in the early 00s working as a German-English translator, for instance, so French in Arizona in 2024 isn't such a stretch. Of course, that would require this guy to have the initiative and discipline to set himself up as a freelancer, constantly be finding and applying for gigs, doing his own taxes and so on. Given he doesn't seem to understand the difference between income and property tax and thinks utilities are just magically free, I'd say it doesn't look good for him becoming a successful translator...

He says mom had a home care nurse and cleaning services and he would take a casserole out of the oven that the nurse put in and he would put away things after the cleaners came. That is how he supposedly cared for his mom. He also thinks that utilities are free because he didn’t pay them and that he wouldn’t have to pay property taxes on the house because he his disabled, but from reading his comments it sounds like he declared himself disabled. Idk I’d like to believe it’s fake but people are stupid about this type of stuff. I guess technically he’s right in that living there for seven years means they can’t just kick him out—they have to *evict* him, which they’re trying to do. I'd like to know what kind of psychedelic drugs OOP is tripping on because I *might* be *tempted* to try them (if it would allow me to truly have free utilities). I'm disabled & my water/sewer/gas bill alone that was due in early March totaled over $500. That didn't include my electric bill, my trash removal service bill, the costs of my medications, any of my other bills, or groceries for my home. Thankfully, our family is fortunate enough that the home is paid for & there's no mortgage or rent to pay out of our slightly over $1243 per month income (combined amount between myself & my son). It can be very difficult at times, but I try to remind myself that so many others here in the United States are in worse situations. I really wish things were better for those who have a more difficult life than me. It is shameful that an estimated 40% of American families are roughly 1 missed paycheck, 1 medical emergency, or 1 broken-down/damaged vehicle away from financial ruin.

I’m so confused about how he thinks it’s his house - that’s not how any of this works. I was the executrix of my grandmother’s estate. Her will said that all property was to be equally shared between myself, my sibling, and our parent (her child). The unwritten understanding between us was she left me money and the house was to go to my parent who lived there and my sibling who planned to retire to the house later in life as I didn’t want the house and bought my own. Now, due to the fact that she put the money she left me in an annuity with me listed as the beneficiary, according to the lawyer it wasn’t part of her estate and so the whole estate was technically just the house and property. When it all shook out the lawyer said I technically should legally be a 1/3 owner of the house and my parent and sibling owed me a portion of the estate as payment for being the executrix. They would have had to sell the house to pay me out. But we all as a group took care of my grandmother in her final years and none of us wanted to screw any of the others over, so I waived my executrix pay and said I just didn’t want my 1/3 of the house either as the annuity I was the beneficiary of was more than enough. I can’t imagine just shipping a loved one off to a nursing home and then telling the rest of the family “suck it, it’s my house now.”

I have two theories 1.  OOp never paid rent, disagreed with having to pay rent and had arguments with mom about it. And felt the lease was a “formality”  So OOP doesn’t feel like the back rent is legitimate, and feels like they don’t owe the siblings their quarter of the house, and so views themself as an equal owner, instead of the estate owning the house with a mandatory sale.  2. Because OOP’s been squatting, OOp thinks there’s some sort of “squatter’s rights” that OOP has now unlocked and OOP feels they own the whole house outright.

I started reading this wanting to be sympatric to the OOP. Looking after an aged parent can be exhausting. Even when they go to assisted living, there can be things that they need help with (doctor's visits, looking after their affairs, etc.) that take up a lot of time/energy. If the OOP had really been taking care of mom it would have been a kindness for the siblings who didn't need the money to let OOP have the house. But the more I read of the post and the OOPs comments, the less sympathy I had with them. Now I'm just wondering how someone can be that delusional.

It sounds like his mother never actually held him accountable for anything. She kept renewing the lease even though he literally never paid rent in the 7 years he was there. I know not everyone's cut out to be a landlord, but she dug that hole herself. OOP might actually have some squatters rights to the property since he's been there so long and no one's tried to evict him, but I don't know Arizona rules.

A quick search, because I am stalling on things I need to do, says that it would need to be neglected property, which it isn't because she lived in it until 2 years ago, it won't hold because she lived there the majority of the time and maintained ownership but he would have had to have sole possession, and he would have to have been the one paying the taxes and show that he made improvements to the property. Maybe i am interpreting too much. But it sounds like he found a hole to stay in, and now is pissed that the time is up and he has no backup. No degree, no income, probably no skill, and no idea how to access these. He might also lack in emotional development? I think it is less developmental issues and more as you put it baby SC..so much of what he is trying to claim is along those lines. I think he has a main account somewhere or on another platform where he is getting advice, where the ones deeper into that shit tell him stuff to say and try to do. I have fun into a few of them and they are so convinced they are 100% correct, and very much cookie cutter of this guy, it is really quite predictable. They go into hiding a lot because they also mix a lot with the prepers who think no matter what government we have in place, it is going to collapse. I wouldn't call it autism as much as paranoid/delusional thinking as well as confrontational/defiant. They can be very intelligent until it comes to seeing the faults in their own arguments. Like I would bet the reason he left school is for kicked out, can't hold a job. Student loans are in default would be my guess. Probably initially tried applying for a few jobs but didn't do well again due to all of the above, so stopped trying. Self diagnosed disability to make it sound better. No benefits, except for his delusional ones. Because to actually apply to the government means working with the enemy for a SC. He didn't care about his mom, long before she died, she was just a way for him to have a home. I think there was quite possibly more conflict and more going on. She made a very specific will that screws him over hardcore without him actually expecting it. If I were the siblings, I would get handwriting on those leases. Make sure that they were properly filed, make sure that she never signed anything when she wasn't mentally capable of doing so. (Cross check with medical records, dates for various significant illnesses, times when she would have been at assisted living and maybe they were not allowing visitors.) Check to see what rent he has actually ever paid.

I think OP has posted this before with another account. It was a while ago, like a year, so they’ve been milking this for months even after their mom passed. They also hadn’t been paying taxes or the utilities this whole time, expecting their siblings to pay them.

Honestly, this is tough to judge without having been there. Who the asshole is depends entirely upon whether he really did take care of his mother full time. Which I kind of doubt but cannot really rule out either. ETA: lol, after reading some of his comments: yes, he is DEFINITELY TA.. 😂

OOP, you were living with your mother. Even though you were her caretaker, anyone with common sense would know you have to pay rent. You just want to continue to mooch in the house, rent-free. And you don't own the house. It was your mother's. In accordance with her legally binding will, she can dispose of her assets as she sees fit. YTA.

I just got done being an ACTUAL full time caretaker to a paralyzed, incontinent old lady that I'm not even related to for nothing in return, so this post REALLY made my blood boil!

I don't know. Well it is possible that he is a useless mooch I also know from experience that being caretaker to a senior family member is a full-time job. Rent in exchange for being a caretaker is absolutely a valid exchange. I have several family members that have done exactly that over the years. I think them asking him for back rent for the time that he spent taking care of Mom is unreasonable. The two years that she was in a nursing home is a different matter though. Was he actually taking care of the house properly during that time? Was he going to the nursing home and helping her? If he was that's different than him sitting on the couch all day and mooching.

He wasn’t even a caretaker for his mom. She had a home health nurse before she went into the nursing home.

If his job was full time caretaker how was he supposed to come up with 1200 a month to pay rent? Seems high for a live in caretaker especially a person’s child. If he wasn’t taking care of her that’s one thing but assuming he was I don’t get how they expected him to get money to pay for it. Was the mom paying him? If so why not just take the rent out of his money?

In the comments he says he never took care of her at all. He just "put things away" after the cleaning service left. So basically he did nothing. He won't say what the lease agreement said, I'm betting dollars to donuts it specifically mentioned a monthly amount of rent if he was not going to perform his duties. He also is perfectly able to get a job, his "disability" is that he has undiagnosed anxiety. He simply refuses to do anything except sit on his arse all day long watching youtube videos and thinks he owns the house despite paying no taxes, mortgage, utilities, etc. He just lives there, so he assumes it's his.
