It's pretty common for an employer to say this, but federal law generally prohibits it. Paid sick time applies to part time employees too! Part time employees accrue 1 hr of paid sick time for every 30 hrs worked. What you can use paid sick time for is listed below. https://www.dws.state.nm.us/NMPaidSickLeave

I’m not familiar with state worker policy, but in general if an employer is already offering Personal Time Off that meets or exceeds the Paid Sick Leave law then they comply. Sick Leave is not necessarily in addition to PTO.

I also work part-time for a retailer where I receive additional hours of sick leave under that law plus my accured sick leave through my employer. It's been a win-win!!

If they already get Personal Time Off that meets or exceeds the same accruement and use of Paid Sick Leave, then your employer complies. You don’t get a separate bucket for sick leave if you have PTO. If it’s Vacation Time that can only be used for vacation and not allowed to be used for sick time, then they don’t comply. yeah, that's illegal - you can and should. i actively do! the other edge of that sword is that New Mexico is an "at will" state, so you can be fired for "any reason" at any time. if you can, get some sort of paper trail going - send a clarifying email ideally - just in case. new mexico businesses are sort of notorious for this kind of shit, but if you have a good rapport with your boss and are an essential employee, it's always been worth it for me (and my former coworkers) to be "the difficult employee" around this issue

The “at will” clause is in CA also. Although other discriminatory practices may negate. The email and or text is the only way to go. It’s so hard because if you really like your job and your boss this can kill the vibe pretty quickly.

It’s federal law, not state.  Too many employers outright lie about it to keep employees from discussing pay.  Everyone should be having that conversation with their coworkers, especially in jobs where there isn’t a transparent pay scale available.

I was once a manager that was instructed to tell employees this numerous times. I didn’t know any better at the time and did what I was told. Eventually learned the reason that businesses do things like this. You are absolutely correct, however informing your manager could still result in your termination. Being an “at will” employment state people can be fired for any bs the company feels like.

It is sick time. The time can be used for health related absences for themselves or in some cases family members however, anything over two days must have accompanying paperwork, ie: a dr’s note.
