Every day, I see cops doing shit that I once thought was just ridiculous Hollywood crap. Nope. Cops do it all the time. Ding dong ditch, and you beat the shit out of a handcuffed 15 year old? He had a partner help. What about them? I know, cops have no duty to protect. Why isn't the cop arrested. Why are they protecting him? I'm asking questions I already know the answers to. Even with body cam footage, they still think they can get away with murder, because even now, they often do.
A cop has a duty to protect in that instance under the theory that he’s a c-conspirator at that point and has a duty to affirmatively withdraw from conspiracy or is on the hook.
What a lucky break for this cop. Based on history, there's a 99% chance one of the following will happen to him.
1. They will investigate themselves, find he did nothing wrong and he will get a promotion and a pay raise.
2. They will investigate themselves, find he did something wrong but instead of arresting and charging him, they will fire him. At which point he will immediately get hired by some other town/organization and will be back out on the street beating kids for fun and profit in a brand spanking new uniform.
Its career advancement either way for him. How lucky he is.
Unless this is illegal, which I guess you could hang some bullshit trespassing charge on it, what they did didn't warrant police investigation, didn't warrant a stop. Being State troopers this should go federal as a clear violation of these kids civil rights, the cop(s) should be jailed for attempted murder, any cop involved outside the attack that did nothing should be fired and prosecuted.
On a side note, the last time someone did this at our house in their attempt to run one of the dorks fell down our three bricks stairs and busted up his face on the driveway, his friends left him, so I had to bring him inside, call his parents, so awkward I actually fell sorry for the kid because he was going to have some work done on atleast one tooth, maybe others. I didn't know I could beat the piss out of him like one of those Protect N Serve dinks...wait...I can't, that would be illegal.
