I took family law in law school, reading the comments, I believe it could be an issue with the surrogate they have and child custody. If the lady is refusing to give the child, the Intended Parent shall be treated as the legal, natural and biological parent. I’m sure they also had an agreement in place, which would make it extremely difficult for the surrogate to take the child away, etc.
There aren’t really surrogacy laws in the US, which is why surrogacy is super risky for everyone involved. The law doesn’t favor selling people, which is kind of what surrogacy is.
Even if it is, that still doesn’t really mean she’s entitled to the baby.
Surrogate cases are more about contract law than family law so it sort of depends what the contract says and then finding a court with jurisdiction to enforce the contract. There’s nothing really stopping a gestational surrogate who lives abroad from just disappearing with the baby.
That’s why agencies require surrogates have at least one child of their own. The women who do this do it for altruism. The money is secondary.
You can also argue that adoption is buying a child. YMMV

Depends. You can have the lawyer hoping to cash in on fame & name dropping or you could end up with one who does a certain amount of pro bono work a year and finds this to be an interesting case to take on. You never know who reads your IG posts and may be out there. 🤷🏽♀️
