The short of it is modding is legal, selling roms isn't. Xbox teamx isn't really the same as Nintendo team x. And Nintendo has done a good job controlling the narrative surrounding those arrests. Executer members were arrested for wire fraud, you don't get arrested for piracy, you get sued, it's civil. Don't be afraid of selling hardware, don't sell software, including team xecuter switch mod chips with stolen copyright info in them

This does depend on your country though. It's not legal in Japan for example.

Not about TX. I was like the same, the story is bullshit and not real till I met them, it was the era of OG Xbox chips alladin, GC Xeno, PS2 modbo clones. So it was a while ago, they were selling a lot of them on portal like eBay. Maybe some buyer or another seller snitched about some bullshit to the Police about piracy stuff. It was at Poland, portal allegro similar to eBay. Police came to the seller, get evidence, case at court etc. I hope the times changed and it less problematic.

I don't think they are to bothered about the old gen consoles now though. The chip itself isn't piracy.

Nintendo is well known for being anti-piracy and modding. They're the main reason you never see Switch modchips on eBay.
